Introduction

These general terms and conditions of sale (GTC) are concluded between :
On the one hand, Fred's Guitar Parts, SIREN 404486177.
And on the other hand, any natural or legal person, « the Customer », exercising a
commercial activity in the field of music, wishing to make a purchase from among the
the products commercialised by Fred's Guitar Parts, hereinafter referred to as the "Product(s)".
The purpose of these conditions is to define the contractual relationship between Fred's Guitar Parts
and the Customer. The GTC are available on the website www.fredguitar.com or on request at contact@fredguitar.com
The fact of placing an order with us implies the acceptance of our general terms and conditions of sale.
Fred's Guitar Parts reserves the right to modify its terms and conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the Customer's order.

Fred's Guitar Parts products

The Products offered for sale by Fred's Guitar Parts are those shown in our printed catalogue and on our website (hereinafter together the "Catalogue"). The delivery time of the Products is subject to the deadlines of the suppliers and manufacturers, which can be very variable.
Fred' Guitar Parts can also order Products outside of the "Catalogue" or custom-made Products at the specific request of the Customer. These special orders cannot be cancelled or taken back.
The information or descriptions of the Products in the Catalogue are given to the Customer for information purposes only.
The images of the Products in the Catalogue are not contractual.

Orders

To open an account and place an order, the Customer must :
1) Create a professional account on the website www.fredguitar.com
2) Send the following elements to contact@fredguitar.com

  • a proof of his professional activity in the field of lutherie or music
  • an Intra-Community VAT number

Orders must be placed online or by e-mail to contact@fredguitar.com

Payment terms and conditions

The Customer chooses his payment method once his account created. Means of payment are :

  • SEPA direct debit (Sepa form downloadable in his professional account)
  • Credit card via a secure payment link sent by email
  • Bank transfer (ask our IBAN at contact@fredguitar.com)

The delivered goods remain the property of Fred's Guitar Parts until full payment has been received. In the event of non-payment of an agreed claim, Fred's Guitar Parts is entitled to recover the goods belonging to it.
In case of particular and exceptional difficulty in paying an invoice, please contact us before the due date.

In the event of several payment delays, Fred's Guitar Parts will suspend shipments of goods and may require cash payments from the Customer for subsequent orders.
Please note that a prepayment is required for each first order.

Rates

Our prices are net, excluding taxes, VAT and postage in addition. They are up to date on the website www.fredguitar.com
Fred's Guitar Parts reserves the right to modify its prices at any time and without notice, the invoicing being made at the price in effect on the day of the order.
Products sold in the B-stock category benefit from a price reduction according to the following criteria : damaged packaging, aesthetic defect, breakage.
Products sold in the Deals category benefit from a price reduction according to the following criteria : references received following an error from a supplier, product stopped by a supplier or by Fred's Guitar Parts.

Availability

Product offers are valid as long as they are online, within the limits of available stocks. In the event of unavailability, Fred's Guitar Parts undertakes to order the product from the supplier, subject to availability at the latter. Fred's Guitar Parts will keep the Customer’s order for 6 months. After this period, the order will be cancelled, except special request from the customer or special orders.

Delivery

The shipping costs are at the Customer's expense and determined according to the weight of the package.
Possible delivery methods are DPD, La Poste and UPS.
The Customer undertakes to transmit all the information necessary for the smooth running of the delivery (road, residence, coded door, floor...). He must also provide a phone number and an e-mail address to be notified by the carrier. For home workshops, it is imperative to mention for the deliverymen the existence of the company at the entrance level.
As soon as the order is dispatched, the Customer receives by email the tracking number of the package and can thus follow the steps of the delivery. If the e-mail is not received, send a message to contact@fredguitar.com
Our goods travel at the risk and peril of the recipient.
It is the responsibility of the latter to unpack his goods in the presence of the carrier. In case of problem, the recipient must within 48 hours :

  • make a reservation with the carrier
  • send an email to contact@fredguitar.com , reporting damage or loss to claim compensation or replacement.

If the package is not delivered within 4 days (working days), the customer undertakes to notify Fred's Guitar Parts at contact@fredguitar.com.
The non-application of these clauses engages the sole responsibility of the recipient and prohibits any recourse.

Return of goods

All Product returns must be requested in advance from Fred's Guitar Parts. Returns of goods in their original packaging are acceptable for a period of 6 months. Packaging and transport costs are at the Customer's expense, except in the case of after-sales service or delivery error
After 6 months following the invoice date, a 30% obsolescence index will be applied to the returned product and therefore to the resulting credit note (conditions will be those in force on the date of the Customer's order).
After 1 year, any return of merchandise will be refused (except in the case of after-sales service).

Each return package must contain a document specifying :

  • The company's contact details
  • The number of the purchase invoice
  • The reason for the return
  • The request for replacement or credit note

A return note is downloadable in the professional account online.
Our equipment is guaranteed for two years (date of invoice), against any manufacturing defect. The warranty is limited to the replacement of defective parts after their return. The guarantee will not be applied in case of misuse, normal wear and tear, damage caused by impact or poor maintenance, or unauthorized technical modifications.

Intellectual Property

The information provided by the Customer is for the exclusive use of Fred's Guitar Parts, which undertakes not to pass on to third parties the information provided by Customers, which remains confidential. For more information, see the section "Privacy policy" online.

Attribution of jurisdiction

All disputes concerning these GTC shall be submitted to the Commercial Court of Toulouse.

Applicable law - Language of the contract

The present GTC and the commercial operations resulting from them are governed by French law.
Only the French version is valid in the event of a dispute.
